WHAT IS MEDIATiON?

ALTERNATIVE DISPUTE RESOLUTION

Mediation is one form of alternative dispute resolution, also known as ADR.  The "alternative" in ADR  means that it is another form of resolving disputes outside of the traditional setting, a courtroom. 


In a mediation, there is no "decider" other than the parties to the dispute. The mediator facilitates the negotiation between the parties and their attorneys. But the parties are in control- if one party doesn't want the deal, they can just say no, and the mediation will result in an impasse. Arbitration is another form of ADR and it is fundamentally different from mediation. 


With arbitration, there is a "decider" who acts like a judge at trial. A private individual (or a panel of multiple people) will hear the details of the dispute and decide on the resolution.

CRAFT YOUR OWN COMPROMISE

Mediation only ends when both sides of the dispute agree on a settlement, or agree that further negotiation would not result in agreement. But either way, you control the outcome, not a judge. 

AVOID UNNECESSARY EXPENSE

Mediation can end your case quickly, and is typically more efficient than preparing and conducting a trial. Further, mediation is now required in most South Carolina disputes. In other words, before you can ask a South Carolina judge to decide your case at trial, you must first attempt to  resolve it via ADR.
